Statement on the processing of personal data

In accordance with Regulation (EU) No 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the "Regulation"), we would like to inform you about the processing of your personal data, in particular in connection with the use of our website q4med.com.

This information does not concern the personal data of legal entities, including the name, legal form and contact details of the legal entity.

This information can be found on our website q4med.com, so you can refer back to it at any time in the future.

Who is the controller of your personal data?

What data do we process about you as a controller and from what sources does this data come?

If you contact us (e.g. via the contact form on our website), we process in particular your following personal data:

  • identification data
  • contact details (e.g. email address)
  • data from our communications with each other

if you are also our (potential) customer or contractual partner or their contact person, we also process your personal data as described in the paragraphs above.

If you subscribe to our newsletter and other commercial communications on our website, we will process your e-mail address.

On what legal basis do we process your personal data?

We process your above personal data because:

  • such processing is necessary for the conclusion and performance of the contract concluded between you and our company;
  • such processing is necessary for the performance of our legal obligations, for example in connection with the issue of tax documents for the supply of goods and services;
  • the processing is necessary for our legitimate interest, specifically consisting in(e):
    • dealing with your enquiries and/or requests,
    • to support our business activities, in particular by sending electronic commercial communications to our customers or contractual partners, whereby such processing can be objected to (for more information, see the section How can you defend yourself against direct marketing carried out without your consent?),
    • to establish, exercise or defend (including the enforcement of) any legal claims against us;
  • you have given your consent to the processing, in particular to the electronic sending of our newsletters and other commercial communications in the event that you are not our customer or contractual partner or, even if you are, you have not objected to this processing of your personal data in the past.

For what purposes do we process your personal data?

We process your above personal data primarily for the purpose of providing you with goods and services. We may also use your email address for direct marketing purposes (in particular in the form of electronic commercial communications) (i) on the basis of our legitimate interest if you are our customer or contractual partner, whereby you may object to such processing free of charge (for more information, please see the section How can you defend yourself against direct marketing carried out without your consent?), or (ii) on the basis of your consent if you are not our customer or contractual partner or, even if you are, you have not objected to such processing of your personal data in the past. If you contact us, we process your personal data in order to process your request or enquiry.

Your personal data is also processed automatically by our employees or contractual partners (for more information, see the section Who is the recipient of the personal data we process about you as a controller?). However, our company does not use your aforementioned data for decisions based purely on automated processing, including profiling in accordance with Article 22(2) of the Regulation.

Who is the recipient of the personal data we process about you as the controller?

We only transfer your personal data to the following categories of recipients in justified cases and to the extent necessary:

  • to our contractual partners that we need either for our normal operation or for the implementation of our contractual relationship with you, e.g. a transport company providing transport of purchased goods;
  • to other entities where we are required to provide such data by generally binding legal regulations or where it is necessary to protect our legitimate interests (e.g. to the courts).

How long is your personal data stored with us?

We retain your personal data for the duration of our contractual relationship and, after its termination, for the limitation period of any related claim. We retain personal data that we process on the basis of your consent for the period for which you have given your consent or until you withdraw your consent if you withdraw it before the expiry of this period. We keep your email address, which we process for direct marketing purposes on the basis of our legitimate interest and not your consent, for 5 years after the termination of our contractual relationship, but no longer than until you object to such processing (for more information, see the section How can you defend yourself against direct marketing carried out without your consent?). If you have contacted us, and if it is not for the performance of a contract or the implementation of pre-contractual measures, we will generally keep your personal data for the duration of the processing of your request and subsequently for the duration of the limitation period of any related claim. Where we are required to do so by mandatory legislation, we will retain documents containing your personal data for the prescribed period. We also retain your personal data for the duration of any litigation. After all of the above periods, our company will destroy all of your personal data, unless it is entitled/obliged to process such data on the basis of another legal title.

What are your rights when processing your personal data and where can you exercise them?

You have the following rights in relation to your personal data:

  • Right of access: you can ask us for access to the personal data we process about you. As the controller of your personal data, we will also provide you with a copy of the personal data we process about you.
  • Right to correction: You can ask us to correct inaccurate or incomplete personal data we process about you.
  • Right to erasure: You can ask us to delete your personal data if any of the following situations occur:
    • the personal data is no longer necessary for the purposes for which it was collected or otherwise processed;
    • you have withdrawn the consent on the basis of which your personal data was processed and there is no other legal basis for processing it;
    • you have objected to being the subject of decision-making based on automated processing of your personal data and there are no overriding legitimate grounds for such processing or you have objected to the processing of your personal data for direct marketing purposes;
    • Your personal data has been unlawfully processed;
    • Your personal data must be erased to comply with a legal obligation under European Union or Member State law to which we are subject as a controller;
    • Your personal data has been collected in connection with the offer of information society services.
  • Right to restriction of processing: you can ask us to restrict the processing of your personal data if any of the following situations occur:
    • you have denied the accuracy of your personal data for the time necessary for us to verify the accuracy of your personal data;
    • the processing of your personal data is unlawful, but you refuse to delete this data and instead request a restriction on its use;
    • our company no longer needs the personal data for processing purposes, but you require it for the establishment, exercise or defence of legal claims;
    • you have objected to the processing of your personal data pursuant to Article 21(1) of the Regulation until it is verified that the legitimate grounds of our company outweigh your legitimate grounds.
  • The right to data portability: in cases of processing based on consent or contract and processed by automated means, you have the right to obtain the personal data concerning you that you have provided to us as controller and to transmit that data to another controller in a structured, commonly used and machine-readable format, provided that this right shall not adversely affect the rights and freedoms of others.
  • Right to withdraw consent: if the processing of your personal data is based on your consent, you have the right to withdraw your consent to the processing of your personal data for the purpose for which you have given your consent at any time, with effect for the future.
  • Right to object: You can object to us processing your personal data at any time on the basis of our legitimate interest and for the purposes of direct marketing carried out on the basis of our legitimate interest (for more information, see the section How can you object to direct marketing carried out without your consent?).
  • Right to lodge a complaint: you have the right to lodge a complaint with the supervisory authority, which in the Czech Republic is the Office for Personal Data Protection, with its registered office at Pplk. Sochor 27, Prague 7, 170 00, Czech Republic, website: www.uoou.cz.

How can you defend yourself against direct marketing carried out without your consent?

You have the right to object to the processing of your personal data for direct marketing purposes, which is carried out without your consent, at any time and free of charge to our company, by:
